An engineering firm was named in a lawsuit in which a bank alleged $3 million worth of design
errors and omissions had been made during the construction of the bank' new facility. The insured's
role in the lawsuit stemmed from their involvement as a consultant on construction of a fountain.
The claim was settled out of court.
Third-Party Suit
A civil and electrical engineering firm is a third-party defendant in a lawsuit with a small
Midwestern city and two of its residents. The suit arose when the residents had land improvement
work done on their properties, which resulted in improper drainage and flooding. The residents
sued the city, which in turn, sued the engineering firm
they hired to review plans and specifications for the project.
Project Manager/Boiler Replacement
An architectural firm is being sued by a city housing authority for work it did on a housing project.
The suit alleges the firm failed to adhere to accepted professional standards regarding architectural
designs and engineering plans and did not properly supervise, oversee and manage the project.
Although the suit arose out of a boiler replacement by a mechanical and electrical sub-consultant,
the architectural firm is being sued in its capacity as the project manager.
Design and Construction Defects
An engineering company is named in a lawsuit brought by members of a church
congregation over design and construction defects in
their church building. Among other things, the suit cites significant
water leakage problems and other defects alleged to
have been caused by negligent professional engineering services.
Bridge Construction Project
An architectural engineering firm that was hired to provide design/build services for a bridge construction
project was named in a lawsuit when a worker was killed during a trench cave-in at a project site.
The employee's estate sought damages in excess
of $2 million, claiming that the firm had specified
and allowed use of an inadequate trench shoring system during excavation for
the bridge's footings.
